Terms of Service

The following terms have the meanings set out below wherever they appear in these Terms, capitalized.

• "Account" means the registered profile through which a Member or Performer accesses the Platform.
• "Member" means a registered user who browses, subscribes to, tips, or otherwise consumes content on the Platform.
• "Performer" means a registered user, approved by Sweetly following identity and age verification, who publishes Content, streams live, and receives payments through the Platform.
• "Content" means any photo, video, live stream, message, or other material uploaded, published, or transmitted by a Performer or Member on the Platform.
• "Tokens" means the virtual, non-transferable in-platform currency purchasable by Members, used to tip Performers and unlock Pay-Per-View Content.
• "Fan Club" means the tiered subscription product through which a Member pays a recurring fee, set by the Performer, to access that Performer's subscriber-only Content and benefits.
• "PPV" or "Pay-Per-View Content" means Content that is locked behind a one-time Token payment set by the Performer, independent of any Fan Club subscription.
• "Payout" means a transfer of a Performer's available earnings, net of the Platform commission, from the Performer's Sweetly balance to a bank account or other payment method nominated by the Performer.

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and have full legal capacity to enter into a binding contract, to register an Account of any kind on Sweetly. By registering, you represent and warrant that you meet these requirements and that all information you provide is accurate and current.

Performers are subject to mandatory identity and age verification before their Account is approved and before any Content is published. This requires the upload of government-issued identification documents and, where requested, a live or photographic verification matching the Performer to the submitted documents. Verification documents are stored securely, are never displayed publicly on the Platform, and are used solely for compliance, safety, and legal record-keeping purposes as described in our Privacy Policy and our 18 U.S.C. §2257 Compliance Statement.

Sweetly reserves the right to request re-verification at any time, to reject an application, or to suspend an Account pending verification, without liability for any resulting delay or loss of access.

The age declaration made at registration, described above, is distinct from the actual age verification addressed in this section: the former is a statement you make, the latter is the outcome of a technical check carried out by a third-party engine. Where the law applicable to your jurisdiction of residence or access requires an actual age check as a condition for accessing adult content, you will be asked to complete it after signing in and before you can use the rest of the site. The list of affected jurisdictions may change over time as applicable law evolves.

Verification runs through GO.cam, an age-estimation engine of which we run our own installation, hosted on our own systems. You may complete it through a webcam-based facial age estimate, or by scanning an identity document. Processing happens entirely inside your browser: the webcam image or the document is never transmitted to us or to the engine's maker, neither of which receives or retains any copy of it. We only receive and store the outcome — passed or not — and the date it occurred. Further technical detail is described on the dedicated Age Verification page and in our Privacy Policy.

If you decline to complete the check when required, or if its outcome is not positive, access to the rest of the Platform remains suspended until you complete it successfully; you may try again. We reserve the right to require a new check at any time, even for an already-verified Account, if we have reason to believe the relevant circumstances have changed or that the prior outcome is no longer reliable.

Sweetly offers two account roles: Member and Performer. A single natural person may hold accounts of both types, subject to separate registration and, for the Performer role, approval following verification.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify us immediately of any unauthorized use of your Account or any other breach of security. Sweetly is not liable for any loss arising from your failure to safeguard your credentials.

To become a Performer, an applicant must submit a complete application, including identity and age verification documents, and be approved by Sweetly. Sweetly reviews applications at its discretion and may deny, delay, or revoke Performer status at any time, including after approval, if eligibility requirements are no longer met or if these Terms are violated.

• Members may browse public profiles, purchase Tokens, tip Performers, subscribe to Fan Clubs, unlock PPV Content, join live streams and chat, and request private sessions where offered.
• Performers may publish photos and videos, set Fan Club tiers and PPV prices, host live streams, chat with Members, purchase advertising banners, and request Payouts of their earnings.

Performers retain ownership of the intellectual property rights in the Content they upload. By publishing Content on Sweetly, a Performer grants Sweetly a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and transmit that Content solely for the purposes of operating, promoting, and providing the Platform, including making it available to Members who have paid the applicable price (free access, Fan Club subscription, or PPV unlock, as designated by the Performer).

Performers represent and warrant that they hold all necessary rights, consents, and releases for every person appearing in their Content, that every such person was at least 18 years old at the time the Content was produced, and that the Content does not infringe any third party's intellectual property, privacy, or other rights. Performers are solely responsible for the legality and accuracy of the Content they publish.

A Member who purchases access to Content (through a Fan Club subscription, a PPV unlock, or a free view) receives a limited, personal, non-transferable, non-sublicensable license to view that Content for personal, non-commercial use. Members may not download, record, screenshot, redistribute, publicly display, or otherwise reproduce Content outside the Platform except where the Performer has expressly enabled a download feature for that specific item. Any unauthorized reproduction or redistribution of Content is a material breach of these Terms and may constitute copyright infringement.

Sweetly does not pre-screen all Content before publication but reserves the right to review, moderate, remove, or restrict access to any Content at any time, at its sole discretion, including in response to a report, a legal notice, or a violation of these Terms.

Tokens are a virtual currency with no cash value outside the Platform. Members purchase Tokens through the Platform using a supported payment method processed by our third-party payment processor. Tokens are used exclusively to tip Performers during live streams or on Content, and to unlock PPV Content.

Fan Club prices and tiers, as well as PPV unlock prices, are set individually by each Performer within any limits set by Sweetly, and may vary between Performers and over time. A Fan Club subscription renews automatically at the applicable recurring price until cancelled by the Member through their account settings, in accordance with the billing terms disclosed at the time of purchase.

Tokens, tips, Fan Club payments, and PPV unlocks are, once processed, non-refundable except where required by applicable consumer protection law or expressly stated otherwise by Sweetly; your last Token purchase can be refunded within 14 days if you have not spent any Tokens since. Digital content and virtual currency of this kind are generally not subject to a statutory right of withdrawal once access has been granted or the purchase has been consumed, to the extent permitted by law. Requests for a refund on the basis of an unauthorized transaction, billing error, or defective service will be reviewed on a case-by-case basis; contact support before initiating a chargeback. Prices for Tokens, and any bundle or promotional pricing, are displayed in the Platform's currency at the time of purchase and are subject to change without retroactive effect on Tokens already purchased.

All payments on Sweetly are processed by independent, PCI-DSS-compliant third-party payment processors. Sweetly does not store full payment card numbers. By making a purchase, you authorize the applicable processor and Sweetly to charge the payment method you provide for the amount of the transaction, including any recurring Fan Club charges until cancelled.

You are responsible for keeping your billing information accurate and up to date. Failed payments may result in suspension of Fan Club access or other paid features until payment is resolved.

Initiating a chargeback or payment dispute without first contacting Sweetly support is a violation of these Terms. Sweetly reserves the right to suspend or terminate the Account of any Member who files a fraudulent, abusive, or unsubstantiated chargeback, to recover the disputed amount and any associated fees, and to pursue any other remedy available at law.

Performers earn a share of the revenue generated from Fan Club subscriptions, tips, and PPV unlocks attributable to their Content and activity, net of the Platform commission disclosed in the Performer dashboard and any applicable payment processing fees. Sweetly retains the right to adjust its standard commission structure prospectively, with notice to Performers as described in Section 15.

Earnings accrue to the Performer's Sweetly balance and become eligible for Payout once they clear any applicable holding period, which allows for chargeback and fraud review. A Performer may request a Payout once their available balance reaches the minimum payout threshold shown in the earnings area of their account. Payouts are processed to the payment method the Performer has verified and nominated, within the timeframe disclosed in the Performer dashboard, subject to identity verification and anti-fraud checks.

Sweetly may withhold, delay, or reverse a Payout, or place a hold on a Performer's balance, where there is a good-faith suspicion of fraud, a pending chargeback, a violation of these Terms, or a legal or regulatory obligation to do so. Performers are responsible for any tax obligations arising from their earnings and for providing any tax documentation Sweetly is required to collect.

Performers who purchase advertising banner placements on the Platform do so at prices and for durations set by Sweetly, payable in advance; banner purchases are a separate paid service from the Performer's content earnings and are subject to Sweetly's advertising content standards.

Sweetly maintains a zero-tolerance policy toward content and conduct that endangers, exploits, or harms any person. The following are absolutely prohibited on the Platform, and any violation will result in immediate Content removal, Account suspension or termination, and referral to law enforcement where appropriate:

• Any Content depicting, describing, or implying a person under the age of 18, in any context, including simulated, animated, or "aged-up" depictions of minors.
• Any non-consensual Content, including content obtained, shared, or distributed without the informed consent of every person depicted ("revenge porn" and similar material).
• Content depicting or promoting sexual violence, incest, bestiality, necrophilia, or any other content prohibited by applicable law.
• Human trafficking, coercion, or any indication that a Performer is acting under duress or control by a third party.
• Impersonation of another person, or the use of another person's likeness or identity without authorization.
• Harassment, threats, hate speech, or discriminatory conduct directed at Performers, Members, or Platform staff.
• Uploading, sharing, or requesting Content that infringes the intellectual property rights of any third party.
• Circumventing the Platform's payment system, soliciting off-platform payments, or directing Members to third-party services in order to avoid Sweetly's fees.
• Using automated tools, bots, or scripts to interact with the Platform, inflate engagement, or manipulate rankings.

Any report alleging that a minor may be involved in Content on the Platform is treated as a critical priority: the reported Content is removed or access-restricted immediately pending investigation, the associated Performer Account is suspended, and, where the report is substantiated or cannot be disproven, the matter is reported to the National Center for Missing & Exploited Children (NCMEC) and/or other competent law enforcement authorities as required by applicable law.

Every profile, piece of Content, live stream, and message on Sweetly can be reported by any user through the in-platform reporting tool. Available report categories include, among others, underage person involved, non-consensual content, harassment or threats, impersonation, intellectual property infringement, and spam.

Reports alleging that an underage person is involved in Content are escalated immediately and handled in accordance with Section 9 above. Sweetly reviews all other reports within a reasonable time and takes appropriate action, which may include content removal, warnings, suspension, or termination of the reported Account.

Members and Performers may mutually block one another. Blocking is bidirectional in effect: once either party blocks the other, neither can view the other's profile, send messages, tip, or otherwise interact through the Platform. Blocking does not retroactively delete Content already purchased or messages already sent.

The Sweetly name, logo, website design, software, and all related trademarks and branding are the property of Tinklab Ltd or its licensors and are protected by intellectual property laws. Nothing in these Terms grants you any right to use Sweetly's trademarks or branding without prior written consent.

If you believe that Content on the Platform infringes your copyright, please refer to our DMCA Policy, which sets out the procedure for submitting a takedown notice and, where applicable, a counter-notice.

Sweetly may suspend or terminate any Account, with or without notice, if we determine in good faith that the Account holder has violated these Terms, engaged in fraudulent or unlawful conduct, posed a risk to the Platform, its users, or any third party, or if required to do so by law or by a payment processor or banking partner.

A Member may close their Account at any time through account settings or by contacting support; active Fan Club subscriptions should be cancelled separately before closing the Account to avoid further charges. A Performer may deactivate their profile at any time; deactivation does not, by itself, entitle the Performer to an accelerated Payout outside the normal Payout process, and any pending holds described in Section 8 continue to apply.

Upon termination for cause, any Token balance, pending earnings, or advertising credit associated with the terminated Account may be forfeited to the extent permitted by applicable law, without prejudice to any other remedy available to Sweetly.

The Platform is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law. Sweetly does not warrant that the Platform will be uninterrupted, secure, or error-free, or that any Content will meet your expectations.

Sweetly acts as an intermediary marketplace and is not the producer of Performer Content. Performers are independent individuals, not employees or agents of Tinklab Ltd, and are solely responsible for the Content they publish and the conduct of their interactions with Members.

To the fullest extent permitted by applicable law, Tinklab Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

You agree to indemnify and hold harmless Tinklab Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your Content, your breach of these Terms, your violation of any applicable law, or your infringement of any third-party right.

Sweetly may modify these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Material changes will be notified through the Platform or by email to registered users at least a reasonable period before they take effect. Continued use of the Platform after a change takes effect constitutes acceptance of the revised Terms; if you do not agree, you must stop using the Platform and may close your Account.

These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation, are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, save that Sweetly may seek injunctive or equivalent urgent relief in any competent jurisdiction to protect its rights.
